Your Handbook Isn't the Law: A PHR Exam Trap

Your Policy Is Not the Answer Key

Ask an HR coordinator what governs a leave request and the fastest answer is usually the employee handbook. That instinct makes sense at work. Your handbook is the document you actually use, day to day, to make decisions.

On the PHR exam, it is frequently the decoy. When a scenario pits internal policy against federal statute, the statute wins - regardless of how reasonable, standard, or well-documented the policy is.

Why This Trap Works on Experienced HR Professionals

The more time you have spent enforcing your company's actual policies, the more automatic "check the handbook" becomes. That automaticity is exactly what the exam is testing against. HRCI is not asking whether you know your employer's rules. It is asking whether you know when those rules are legally unenforceable.

The Scenario

The employee handbook requires 90 days of continuous employment before any leave request is considered. An employee requests intermittent leave as a disability accommodation in week 3. What governs?

Denying the request because the handbook requires 90 days first is the tempting answer - it is literally what the policy says. Approving automatically without any review overcorrects in the other direction. The correct answer is to engage in the interactive accommodation process regardless of tenure, because that is what the ADA requires.

Your handbook's tenure rule was written for standard leave, not disability accommodation. The ADA's interactive process applies from day one of employment. A policy that conflicts with the statute loses, every time.

How to Spot This Pattern on the Exam

Watch for scenarios that state a specific internal policy in concrete terms - a number of days, a step count, a threshold - and then introduce a legally protected circumstance that the policy does not carve out an exception for. The specificity of the policy is the bait. The absence of a legal exception is the trap.

What Tutor Mode Shows That a Generic Answer Key Does Not

A standard explanation tells you the ADA governs. It does not walk through why the 90-day figure felt so authoritative in the first place - precisely because it is the kind of concrete, memorable number your own workplace trained you to trust. Tutor Mode names that instinct directly and shows you the statute that overrides it.
