Terms of Service

Welcome to Certimeister. These Terms of Service ("Terms") govern your use of our HR certification preparation platform and services. By accessing or using Certimeister, you agree to be bound by these Terms. If you disagree with any part of these terms, you may not access or use our services.

1. Acceptance of Terms

By creating an account, accessing, or using the Certimeister platform, you agree to be bound by these Terms of Service and all applicable laws and regulations. You also agree to comply with our Privacy Policy and Cookie Policy. If you do not agree with any of these terms, you are prohibited from using or accessing our services.

2. User Accounts

To access our services, you must create an account by providing accurate, complete, and current information. You may register using an email and password or through Google OAuth. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You must be at least 18 years old or the age of majority in your jurisdiction to create an account. By creating an account, you represent that you meet this age requirement.

You agree to notify us immediately of any unauthorized access or use of your account. Failure to maintain accurate account information or any breach of security may result in termination of your account.

3. Subscription Services

Certimeister operates as a subscription-based platform. You may choose from the following billing cycles when purchasing a subscription:

  • Monthly billing
  • Quarterly billing (every 3 months)
  • Semi-annual billing (every 6 months)

Your subscription will automatically renew at the end of each billing cycle unless you cancel it before the renewal date. You will be charged the then-current subscription rate for your selected billing cycle. We reserve the right to modify subscription prices with at least 30 days' notice.

4. Free Trial

New users are eligible for a 7-day free trial period. During the free trial, you have full access to all platform features including practice tests, flashcards, study materials, and mentorship bookings.

To start your free trial, you must provide valid payment information to Stripe, our payment processor. You will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically begin, and your payment method will be charged.

Free trials are limited to one per user and one per payment method. We reserve the right to verify eligibility and deny free trial access to prevent abuse.

5. Cancellation and Refunds

You may cancel your subscription at any time through your account settings or by contacting our support team. When you cancel:

  • Your access to the platform will continue until the end of your current billing period
  • You will not be charged for subsequent billing cycles
  • Your learning progress and data will be retained for 90 days

Refund Policy: Subscription payments are generally non-refundable. However, if you are not satisfied with our service, you may request a refund within 7 days of your initial subscription purchase (excluding free trial conversions). To request a refund, contact us at support@certimeister.com.

We do not provide partial refunds for unused portions of a billing cycle. Refunds are processed through Stripe and may take 5-10 business days to appear in your account.

6. Mentorship Services

As part of your subscription, you may have access to mentorship services, including booking sessions with certified HR professionals. When using mentorship services:

  • You agree to treat mentors with respect and professionalism
  • Session cancellations must be made at least 24 hours in advance
  • Mentors are independent professionals and their advice is for educational purposes only
  • We are not responsible for the specific advice or guidance provided by mentors
  • Inappropriate behavior may result in immediate suspension of mentorship privileges or account termination

7. Intellectual Property

All content on the Certimeister platform, including but not limited to practice tests, flashcards, study materials, videos, text, graphics, logos, and software, is the exclusive property of Certimeister and its licensors. This content is protected by copyright, trademark, and other intellectual property laws.

Your subscription grants you a limited, non-exclusive, non-transferable license to access and use our content for your personal certification preparation purposes only. You may not:

  • Copy, reproduce, or distribute our content
  • Share your account credentials with others
  • Use automated tools to scrape or download content from our platform
  • Create derivative works based on our content
  • Use our content for commercial purposes or to train others

8. User Conduct

You agree to use Certimeister in a lawful and respectful manner. You may not:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Transmit spam, malware, viruses, or any harmful code
  • Impersonate another person or entity
  • Harass, abuse, or harm other users or mentors
  • Attempt to gain unauthorized access to our systems or other users' accounts
  • Interfere with or disrupt the operation of our platform
  • Use our platform to cheat on actual certification exams

Violation of these conduct rules may result in immediate suspension or termination of your account without refund.

9. Payment Terms

All payments are processed securely through Stripe, our third-party payment processor. By subscribing, you authorize Stripe to charge your payment method on a recurring basis according to your selected billing cycle.

You agree to provide current, complete, and accurate payment information. You must promptly update your payment method if it expires or changes to ensure uninterrupted service.

If a payment fails, we will attempt to process it again. After multiple failed payment attempts, your subscription may be suspended or cancelled. You are responsible for any fees charged by your financial institution related to declined transactions.

10. Limitation of Liability

To the fullest extent permitted by law, Certimeister, its officers, directors, employees, partners, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses resulting from:

  • Your access to or use of or inability to access our services
  • Any conduct or content of mentors or other users
  • Unauthorized access to or alteration of your data
  • Your reliance on information obtained through our platform
  • Failure to pass any certification exam or achieve career goals

Our services are provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that our platform will be uninterrupted, secure, or error-free.

Our total liability to you for any claims arising from your use of our services shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including but not limited to:

  • Breach of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of our services or other users
  • Non-payment of subscription fees
  • Extended period of inactivity

Upon termination, your right to access and use our services will immediately cease. We may delete your account data in accordance with our data retention policies. Termination does not relieve you of any payment obligations incurred prior to termination.

You may terminate your account at any time by canceling your subscription and contacting support@certimeister.com to request account deletion.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of the Province of Quebec, Canada.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
